Terms and Conditions

LIABILITY RELEASE AND ASSUMPTION OF RISK 

Important Notice: By choosing to participate in the Christmas Bird Count (CBC), you acknowledge that you assume certain risks associated with outdoor activities and agree to release Audubon and Birds Canada from liability as described in this document. Please read carefully before participating. 

Note for Parents/Guardians: Any parent or legal guardian participating with a minor under 18 years of age agrees to these terms on behalf of the minor and accepts responsibility for their supervision and compliance during CBC activities. 

Assumption of Risk 

I agree to follow the instructions of CBC Program Leaders. I understand how to use any equipment I might need for the count (binoculars, mobile devices). I understand that there are possible dangers associated with the CBC, including, but not limited to, outdoor weather conditions, uneven terrain, wildlife encounters, and birding by vehicle travel. 

I understand that participation in the CBC may involve physical activity, and that different participation roles may have different physical requirements. I am responsible for assessing my own capabilities and choosing participation activities appropriate to my abilities. If I am participating with a minor (under age 18) in my care, I am responsible for assessing their capabilities and supervising their participation in activities appropriate to their abilities. 

I agree that I am participating in the CBC at my own risk and acknowledge that Audubon and Birds Canada have made no warranty or representation, expressed or implied, regarding the safety of conducting the CBC. 

Release of Liability 

I expressly release and hold harmless Audubon and Birds Canada and its officers, directors, employees, agents, volunteers, licensees, successors and assigns from and for any and all claims, demands, actions and causes of action whatsoever for any loss, damage or injury to person or to property suffered or incurred by me or by any minor in my care in connection with the CBC or any aspect of it, including, but not limited to, any transportation arranged by, paid for or provided by Audubon or Birds Canada. This release shall be binding upon me and my heirs, next of kin, executors, administrators and assigns. 

Acknowledgment and Agreement 

By participating in the Christmas Bird Count, you acknowledge that you have read, understood, and agreed to be bound by this Liability Release and Assumption of Risk. Participation in any CBC Count activity constitutes acceptance of these terms.
